Reports have documented this steady decline in civic understanding. In 1998, the Department of Education found that 75 percent of high school seniors were “not proficient in civics; one third lacked even a basic comprehension of how the government operates, while only 9 percent could give two reasons why citizens should participate in the democratic process.” A report in 2002 concluded “that the nation's citizenry is woefully under-educated about the fundamentals of our American Democracy.”

This lack of connection is producing a dangerous spiral of frustration and disenchantment. On the one hand, Americans take the existence of our democracy for granted, while, on the other hand, being frustrated with its workings. This produces a dangerous spiral of frustration and disenchantment. Observes Bok: “Americans have expectations for politics and the political process that are often unrealistic. Convinced that presidents can often accomplish more than is humanly possible, that legislators should be able to arrive at sensible decisions without prolonged disagreement or controversy, and that politicians should refrain from pandering to the voters yet still reflect the views of their constituents, the public seems fated to endure repeated disappointment over the government and those who run it.”

Some Americans respond to this disappointment by demanding changes in the system, others by distancing themselves from the system, which leaves those who stay engaged more powerful to push for the agenda they want.

Those demands for change come in two basic forms, although proponents of each argue that their proposals would make the system more democratic by shifting power. There are the Lloyd Cutlers, Oliver Norths and Dick Cheneys who want to shift more power to the president so he can either force the rest of the government to respond or just act without being fettered by the process. And there are others who want to shift more power directly to citizens so they can force the government to respond, or simply go around the process. That they want such changes is within their rights. But any meaningful argument for them must occur in the context of the lessons the framers learned long ago. Without this context, we risk making changes that dismantle what has been proven right about our system and even endanger the freedoms it was built to guarantee.

It might be helpful to restate those lessons, in a simple form that everyone can paste on their refrigerator.

The framers boiled their experience down to a Constitution. We have boiled their experience down to these five lessons.

1. Everyone is selfish. This is not to say that people cannot act well or perform acts of great nobility. But essentially people act to achieve their own self-interest, particularly at the level at which government operates: regulating conduct and redistributing wealth. People are, however, willing to trade one benefit for another and sometimes even sacrifice a narrow interest for a broader one that they feel will ultimately do them more good. The government's job is to find those areas of common ground. That is where we can build a common good.

2. Government is the steam valve of society. It funnels and relieves the pressures that build from competing interests.

3. Political process is more important than product. Consensus around a flawed plan can still produce great progress. (The Constitution itself is the best example.) But a “perfect plan” without consensus will only produce conflict and deadlock. (The Clinton health care debacle is one example.) Respect for the system is thus a vital prerequisite for progress. When respect is in such short supply, it is no surprise that progress is, as well.

4. The strength of consensus is directly related to the breadth of representation and the depth of deliberation. A sound-bite society where civic education has vanished has little basis for forging strong consensus.

5. Every interest is a special one. The founders would no doubt be amazed by the scale and power of modern corporations and trade unions. But they would have no difficulty at all with the idea that everyone has wants and desires and that these drive their views and their allegiances to groups and factions. To them, the only meaningful definition of the
common good
would be the agreement that emerged from an inclusive political and legislative process to resolve competing (special) interests.

Our world is very different from that of the framers. People have powers now they could not have dreamed of then. Information, the lifeblood of democracy, moved then at the speed of sail. It moves now at the speed of light.

But there is no evidence that people have changed. Therefore, we see no reason to abandon the lessons the framers formed about people or the system they built from those lessons. Indeed, some of the changes, most particularly the speed with which society can now move, only reinforce the need for care in our political deliberations and for the speed bumps in the process that prevent us from rushing to judgment. That is what the framers built for us.

Recent experience reminds us that we make mistakes as a country when we move away from how our system was built to work. When people say now they wish the Congress and the media had done more to question the march to war in Iraq, they are saying, too, that they wish the leaders of Congress and of the press had done more to assert their authority, and fulfill their responsibilities, under, respectively, Article 1 and the First Amendment to the Constitution. Even many proponents of the war concede now that the checks and balances did not work well. We believe this failure was due to the weakening of our sense of constitutional roles, of our Constitutional Conscience.

We as Americans need to continue to remind ourselves of the framers' concern that democracy was fragile.

So far, unlike in the past, no one is openly arguing for an abandonment of democracy. Indeed, what many Americans think we need is what they see as more democracy. Both the proponents of strengthened presidential power and the proponents of direct democracy argue that their proposals would make the system more representative of the general public: the president as the only nationally elected official, and direct democracy as the only means to involve Americans more directly in the decision-making processes. Either way, the argument is for a more direct engagement and less entanglement in Washington process. We understand those feelings. They rise historically from a treasured strain of American belief running back to, at least, Tom Paine, the Declaration of Independence and the Articles of Confederation.

But we must not forget the warning of the framers that the most likely undoing of democracy would be in the name of more democracy.

That thought is why we wrote this book. We wanted to pick up the dropped narrative thread of the American democratic story, to remind ourselves that the democratic thinking of 1776 is only the first half of our legacy. The second half was born of Madison and his colleagues in 1787. The framers in 1787 saw liberty and direct democracy as inadequate on their own to ensure the very democracy they purported to further. For in the real world in which government works, this directly democratic perspective translates into one group getting its way over the interest of other groups or one branch, whether a powerful legislature or monarchical president, getting too much power over everyone else.

The framers' ideas transformed the thirst for liberty into a real nation. Madison and his colleagues invented a form of government whose purpose, as the historian Gordon Wood summed it up, was not to transcend our differences but to reconcile them.

Americans' current frustration and anger with their government is sapping their commitment to the principles that have made the country work. Rather than drift away from the Constitution, we should renew our connection to it. We should remember that consultation and process and debate are good things, even when they slow and complicate decisions. Most of all, we should remind each other that compromise is a show of strength, not weakness. Reaffirming these constitutional principles will actually address our frustration better than inventing something different, or more accurately, returning to what did not work between 1776 and 1787.

People say that what they want is compromise and consensus. The framers believed in that. It is why the most important and radical word in the Constitution was the first word,

. The government was the people and is the people. The power of each branch of government is a grant from the people, and each branch to one degree or another is accountable to them. Nothing like this had ever been created before. One British political leader, comparing the evolution of Britain's unwritten constitution to the seemingly overnight drafting of the U.S. Constitution, called the latter “the most wonderful work ever struck off at a given time by the brain and purpose of man.”

But Americans in practice, in the grind of life, are no longer seeing it this way. For one thing, they do not connect their desire for consensus with the Constitution's governmental design. For another, they routinely, and predictably, define the consensus they want as the achievement of their own goals, not something larger. Americans' demands on government are today broad and deeply diverse. And when they are in an uncompromising mood, when they are divided fifty-fifty, red from blue, their representative government reflects this division, and it stalls.

The problem is not that government is unrepresentative. The problem, if you want to call it that, is that the government is very representative. The message we are hearing is that our government does not work. The message we should be hearing is that our government is a reflection of our own divisions. What we need is not a new system of government. We need a renewed willingness to work out our differences and find compromises, consensus and that other now-popular phrase, common ground.

The purpose of American-style democracy is not to guarantee each of us what we want individually. It is to give each of us as large an opportunity as possible to pursue what we want within the limits the Constitution and our Constitutional Conscience impose on us. This tension between individual liberty and community restraint has over time produced a great deal of good for a great many people and worked better than any alternative yet tried. It is still the best system for our sprawling, complicated nation.

To say that ours is the best system is not to say that it is a perfect system. It is not and never will be perfect. It can't be. It is composed of we, the people, with all our flaws. That is the point. We make it work. Our drive. Our demands. Our participation! In 1888, the poet and editor James Russell Lowell remarked on the “splended complacency” he found among his fellow Americans who were “neglectful” of their “political duties.” He traced this neglect back to a widespread but mistaken belief that the framers of the Constitution had “invented a machine that would go of itself.” Lowell said he admired the ability of Americans to let “confidence in our luck” and “absorption with material interests” subsume attention to the state of our democracy.

But Lowell's warning was plain.

In the midst of the rising tide of antigovernment sentiment of the 1980s, Professor Michael Kammen thought this message was so important that he used Lowell's phrase, a machine that would go of itself, as the title of his book on the Constitution and constitutionalism. A hundred years apart, the poet and the professor were trying to send us the same warning. Our system is not a machine that will go of itself. The evidence for this is all around us now. As we have drifted from constitutional principles in recent years, our system is working less well. But these problems are not about the design of the system; they are problems in the system and in the weakening of the Constitutional Conscience of its participants. That is a crucial distinction. The problems are directly related to the weak connection between the public and our leaders and the principles of the Constitution.

These problems have been building for years. By the end of the 1980s, politicians in Washington were in open despair that the political system was unable to deal with the problems facing the country. The political deterioration has grown steadily worse. Not surprisingly, since it is our most representative branch of government, the dysfunction is most visible in the Congress. In a nation of citizens so lacking in an understanding of our system, it is hardly surprising that, increasingly, the men and women they send to Washington don't make an adherence to constitutional principles an important part of their daily work. “People revere the Constitution yet know so little about it—and that goes for some of my fellow senators,” said the Senate's top institutionalist, Robert Byrd of West Virginia.

The framers counted on a balance of power between Congress and the president. They were, critically, intended to watch each other. But, as we explored in chapter 7, in the last few years, Congress has wavered in the exercise of its constitutional duty.

The weakness of the legislature throws off the whole design of the system. The strong reassertions of presidential prerogatives would not have surprised the framers. They would have expected this, although some may have been surprised at the degree. “You must . . . oblige [the government] to control itself,” Madison wrote. The American system counts on each branch asserting its authority, just as it counts on each individual to press his or her wishes. Balance is essential to the framers' design, but to find the right balance each participant has to push and pull. The danger comes when one branch pushes and the other folds.

When then-Representative Dick Cheney defended Oliver North's crimes as an expression of the president's all but stated “monarchial” authority, he was expressing a very narrow minority view in Congress. But then that minority became the majority, controlled Congress, and Cheney became the vice president. Under his leadership, the “monarchical executive argument” was then “deployed.”

The imbalance we refer to here is far more than the common instinct of members of Congress trying to protect a president of the same party. To some extent, this will always happen. But American history is marked with examples of members of Congress of each party asserting their institutional, constitutional role and challenging a president of their own party. Senator Harry S. Truman investigated President Roosevelt's administration, and Senator Lyndon B. Johnson investigated president Truman's administration. It was a Republican senator, Howard Baker, whose incessant questions crystallized the belief that a Republican president knew more about Watergate than he had told. And it was a Democratic senator, Daniel Patrick Moynihan, who blocked the Democratic president and his wife from their plan to overhaul American health care. Moynihan's critique was a classic defense of constitutional process. The Clintons drafted their plan, Moynihan complained, behind closed doors and failed to consult the Congress or build a consensus. And a few Republican legislators had begun challenging President George W. Bush's Iraq policy by the end of 2006.
